RAD PRIVACY POLICY AND TERMS OF USE

Privacy Policy

Rad Golf, Inc. (“Rad”) provides online and mobile services, including the Pinpoint mobile application (the “App”), website (“radgolf.com” or the “Site”), and other mobile-communications and web-based services intended to enhance your use of the Rad Golf products (the “Products”).

This privacy policy (“Privacy Policy”) describes the privacy practices for our devices, App, software, websites, Products, and services (collectively, the “Services”), the data we collect, how we use it, the controls we give you over your information, and the measures we take to keep it safe.

Information You Provide to Us

If you choose to purchase Products and/or Services from the Site, you will be required to provide the following personal information: your name, credit card information, telephone number, mailing/shipping address and email address. Rad collects personal information to process orders, contact regarding your order and/or answer your questions or concerns. Your personal information is collected in the following ways:

Communications with Rad: Rad may collect information from you, such as your name, email address, phone number or mailing address, when you choose to request information about our Products and Services, register to receive Rad newsletters and other communications by emails and/or SMS messages, participate in promotions or loyalty programs that Rad may offer from time to time, request to receive support or otherwise communicate with Rad.

Purchases and Subscriptions: If you purchase Products directly from Rad or register for a paid subscription/service plan (“Membership”), you provide your payment information, including name, credit or debit card number, card expiration date, CVV code, and billing address. Your credit or debit card information is processed by third-party payment processors and by using the third-party merchant to process your payment information you agree to hold Rad harmless for any actions taken by such third-party. 

Personal Information: Rad collects non-financial personal information from its members, including free members. By creating an account with Rad, you authorize Rad to collect and retain your personal information, such as your name, username, email address, password, and telephone number. Third-party traffic and analytic management software collects information through Cookies set on your computer if your computer allows Cookies ("Analytic Software"). Information gathered by the Analytic Software may be associated with your personal information. 

Online Membership Registration: You do not have to register on the Site to shop online. Membership may be offered for free, with access to "free" sections of the Site or App. Paid members receive additional benefits, and access to data files.

Marketing: When registering, the opt in to receive Rad marketing promotions is pre-selected. Opt in recipients receive other forms of email and text message (“SMS”) communication, such as special offers. You specifically authorize Rad to send you email and SMS communications until you opt out. You may opt out of Rad email and SMS as well as any form of non-transactional communication from within your account. If you opt to receive emails, Rad will share your name and email address with the email service provider to deliver email marketing information, use of this information is only permitted in connection with administration and delivery of the email program. Rad uses personal information for marketing purposes, such as developing and providing promotional and advertising materials that may be of interest to you; analyzing the effectiveness of those materials and customizing and improving them.

Surveys: Rad may conduct voluntary surveys through the Site, App or email. The surveys may ask customers for background information and about their preferences. You are not obligated to participate. The information Rad collects through surveys is used to better serve customers and improve satisfaction. Rad does not sell any information gathered in the surveys but may share the results with Corporate or Business Affiliates in accordance with this Privacy Policy.

Tell-A-Friend Email: You must provide your email address and the recipient's email address to send a personal greeting to whomever you designate. Rad does not use the email address or information contained in these greetings, except to complete the service you requested. By using the service, you affirm that the recipient of your message consented to provide the email address for the purpose of sending the message and any attached information.

Third-Party Vendors: Third parties may offer separate products and services through advertisements on our App our Site and through the Services that may be complementary to your use of our Products and Services. If you choose to use these separate products or services, disclose information to the providers, or grant the third parties’ permission to collect information about you, their use of your information is governed by their privacy policies and not by Rad.

Personal Data Rad Collects from You:

Rad strives to collect only the personal data we need. Personal information collected depends on how you interact with Rad. Descriptions of how Rad handles personal data for certain individual services are available in settings related to those features.

When you purchase and/or activate a Product or device, download a software update, connect to our Services, contact us (including by social media), participate in an online survey, or otherwise interact with Rad, we may collect a variety of information, including:

  •  Account Information: Account details, such as: email address, registered devices, account status and age.
  • Device Information: Identification, such as device serial number or browser type.
  • Contact Information: Data such as name, email address, physical address, phone number and other contact information.
  • Payment Information: Data about your billing address and method of payment, such as bank details, credit, debit or other payment card information.
  • Transaction Information: Data about purchases of Rad products and services or transactions facilitated by Rad.
  • Fraud Prevention Information: Data to help identify and prevent fraud, including device trust score.
  • Usage Data: Data about your activity on and use of our offerings, such as App launches within our services, including browsing history; search history; product interaction; crash data, performance and other diagnostic data; and other usage data.
  • Location Information: Precise user location data relating to golf course information, and location on course. Location data is stored in Rad’s servers and will not be distributed to third-party vendors.
  • Government ID Data: In certain jurisdictions, we may ask for a government-issued ID in limited circumstances as required by law.
  • Other Information: Data you provide, such as the content of your communications with Rad, including interactions with customer support and contacts through social media channels.

You are not required to provide personal information when requested. However, failure to do so in many cases will limit Rad’s ability to provide you with our Products or Services or respond to requests you may have.

Technical Information:

Cookies: Rad collects and aggregates information on thousands of site visits about how users navigate the Site. Rad analyzes this information to improve the Site by gearing it to users’ preferences. Rad may share this information with affiliates or other third-party companies to indicate the interest in the Site and make technical improvements. This aggregated information will not identify you individually or any other user of the Site.

Cookies identify your computer and not your email address. Rad uses cookies to track items you placed in your shopping cart during a single shopping session. Cookies automatically expire when you have not returned to the Site for a certain period of time. Your browser must be set to accept cookies before you can place an order. Rad Business Partners may use cookies on the Site. Rad has no access to, or control over these cookies once partners are given permission to use cookies for advertising purposes.

Analytical Data: We work with partners who provide us with analytics and advertising services. This includes helping us understand how users interact with the Services, selling advertisements on our behalf across the Internet, and measuring the performance of those advertisements. The analytic service providers, and advertising software may use cookies and may receive information about your browsing and buying activity on the Site. This information may include your Internet Protocol (IP) address, your computer’s operating system, browser type and the address of a referring website, if any.

Personal Data Received from Other Sources: Rad may receive personal data about you from other individuals, businesses or third parties acting at your direction, from our partners who work with us to provide our Products and Services and assist us in security and fraud prevention, and from other lawful sources.

  • Individuals: Rad may collect data about you from other individuals — for example, someone sent you a Product or gift card, invited you to participate in a Rad Service or shared content with you.
  • At Your Direction: You may direct other individuals or third parties to share data with Rad. For example, you may direct your mobile carrier to share data about your carrier account with Rad for account activation.
  • Rad Partners: Rad may validate information you provide with a third party for security and fraud-prevention purposes.

Research and development purposes: Rad may use datasets which contain images, voices or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law, including law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to re-identify individuals who may appear therein.

How We Use Your Data:

Provide our Products and Services: We use information we collect to provide you with our Products and Services. We use your golf data to track your performance and provide you with our Services. We may also use your information to administer your account, send push notifications when you are using the Services, send you emails and/or SMS messages, and connect you with other people who may use the Services. We use information we collect to tailor our Products and Services to you, including to assess your needs and determine suitable content and Services.

We may use information we collect to ship Products to you, notify you of changes to our Terms of Use or related policies, to provide information about our Products and Services, to respond to questions, concerns and customer service requests, and to send you promotional communication via email and/or SMS messages. The information is also used to customize content available on the Services and to improve the quality of advertisements that offer third-party products and services. You may opt out of Rad email marketing and other email communications at any time by choosing the unsubscribe link in a message or select "No" in your profile after registration. Transactional emails may not be opted out of as they relate to your Services, devices and billing.

Maintain and Improve our Products and Services: We may use information we collect to conduct research and analysis relating to our Products and Services, and to improve the overall experience of our users. We also use the information to troubleshoot and product against errors; perform data analysis and testing; conduct research and surveys; and develop new features and Services. We may use aggregate, de-identified location or other data, alone or together with information obtained from other sources, to help us improve our Products and Services or develop new Products and Services, or to share and report statistics through the Services.

Promote Safety and Security: We use the information we collect for other legitimate purposes to promote the safety and security of our Products and Services, our users, and other parties. We may use the information to authenticate users, facilitate secure payments, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies. 

Grounds for Processing: We only collect and use personal data where we have lawful grounds to do so. These include processing personal data to provide our Products and Services, for purposes of our legitimate interests or those of other parties, to fulfill our legal obligations, or based on consent.

Rad Golf Tournaments: From time to time, users may be able to participate in regional and national Rad Golf Tournaments, which will display a user-created display name and play data to other users, but will not display the user’s personal identifying information, zip code, or user device details.

How We Share Personal Data

User Consent: You may direct us to disclose your information to third parties. You may also direct us to share your information in other ways, such as when you give a third-party application access to your account. For example, if you connect your account to Facebook or Twitter, we may disclose your information to those applications.    

Service Providers: We transfer information to our service providers who process it for us, based on our instructions, and in compliance with this Privacy Policy, applicable law, and appropriate confidentiality and security measures. These service providers provide us with services including customer support, information technology, payments, sales, marketing, data storage and analysis, research and surveys.

We may share the information we collect with companies that provide support services to us (such as printers, e-mail providers, marketing services, analytics providers, web hosting providers, call center/chat providers, sweepstakes vendors, payment processors, data enhancement services, fraud prevention providers or shipping services providers, including product vendors) or that help us market our Products and Services. These companies may need information about you in order to perform their functions. We limit information shared with service providers to what is necessary to fulfill the services.

Non-identifiable Or Aggregate Information: We may share non-identifiable or aggregate information with third parties for lawful purposes such as market research and targeted advertising.

Public Information: We may share or disclose your public information, including your public profile information such as your name, username and profile picture, as well as any other information on your profile that you choose to make public. Public information also includes content, such as data from your use of the Products, that you choose to share on or through the Services, as well as your interactions with content shared by others.

Legal Requirements: We may disclose information we collect when we believe disclosure is appropriate to comply with the law; to enforce or apply applicable terms and conditions and other agreements; to prevent, detect, or investigate illegal activity, fraud, or abuse; to facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or disposal of all or part of our business or assets; or to protect the rights, property or safety of our company, our customers and others.

Business Partners: We may share information with business partners, such as retailers and manufacturers of golf equipment, with whom we may jointly offer our Products and Services, or whose products or services we believe may be of interest to you.

Business Transfers: In connection with the sale or transfer of some or all of our business assets, we may transfer personal information. We also may retain a copy of that information.

Security:

Rad has electronic and corporate policies and procedures in place for the security of every order placed online. Secure Socket Layer technology (SSL) keeps others from intercepting your information while being transmitted across the Internet. SSL technology is the industry standard method of communicating secure online transactions and is built into most major browsers. The secure mode begins when you initiate your order. All information, once on the Rad server, is protected from any external intrusions. Once your order is processed, Rad does not retain your credit card number in the online systems. Only Rad employees who require your personal information to serve you have access to your data, which is password protected. SSL protects information sent to Rad, and the security certificate confirms Rad is the recipients of this information. Rad strives to protect your data with the utmost care at all steps in the process. However, no data transmission over the Internet or any wireless network can be guaranteed to be absolutely secure. Rad does not warrant or ensure the security of any information sent to Rad online.

Email Abuse: Fake emails that appear to be, but are not, sent from reputable sources, such as Rad, are known as "phishing," which is an attempt to trick unwary recipients of an email into divulging personal information. If you have any question about the genuineness of an email you receive that appears to be from Rad, please contact us. Do not furnish any personal information in response to the email unless its authenticity can be verified. 

Transaction Security

Secured communications on the internet require attention to authentication, encryption and data integrity. All three are addressed by the Secure Socket Layer (SSL) protocol. Authentication is the process of establishing your connection with the web server, rather than another server assuming Rad identity. Rad obtained a digital security certificate from Go Daddy Secure Certification Authority. The security certificate confirms Rad is the recipients of your communication.

Encryption is the process of scrambling data (through use of keys and mathematical encoding algorithms) to prohibit the data from being understood between your browser and the server. Encryption protects communications between your browser and Rad Site. To ensure you are in SSL or secure mode for your transactions, look at the address of the page. Secure pages usually have an address of 'https://'.

Child Policy: Our Services are not directed to children under the age of 18 and Rad does not knowingly collect personal data from children under 18. If you are under the age of 18, do not submit any information to Rad without the express consent and participation of your parent or guardian If you believe your child under the age of 13 has provided Rad with personal data without your consent, please contact Rad immediately. If we become aware that a child under 13 (or under the age of 16 in certain jurisdictions) has provided us with personal data, Rad will take reasonable steps to delete the personal data as soon as possible and terminate the child’s account.

Links: Rad may provide links to affiliated entities and to other websites. These sites operate independently of Rad and have established their own privacy and security policies. For the best online experience, please review the privacy policies and terms before submitting any personal information through other websites.

Consent to Transfer: The Site is operated in the United States (“US”). If you are outside the US, the information you provide to Rad will be transferred to and within the US. By using the Site or App and providing personal information through the Site or App, you consent to this transfer.

Canadian Residents: except as restricted by law, are entitled to access their personal information collected by Rad by writing to: Rad Technologies, Customer Service Privacy Director, 2308 Kettner Blvd., Suite B, San Diego, CA 92101. Rad may ask you to pay an administrative fee for accessing or copying your information, but will inform you of the anticipated charges and confirm before processing your request. If you believe information collected is incomplete or inaccurate, Rad will correct the information upon verification of the omission or error and the identity of the person requesting the change.

California Residents: in addition to the rights set forth above, you have the right to request information from Rad regarding how certain categories of your personal information are shared with third parties, for the third parties' direct marketing purposes. California law provides you the right to submit a request to us at the designated address and receive the following information: The categories of information disclosed to third parties for the third parties direct marketing purposes during the preceding calendar year; names and addresses of third parties that received such information; and if the nature of a third party's business cannot be reasonably determined from the third party's name, examples of the products or services marketed.

Updates to this Statement: Rad reserves the right to make changes at any time to its policies and/or alter the look and functionality of the Site. If there are changes to the use of your personal information, Rad will post the policy change and update this Statement accordingly. Rad encourages you to periodically review this Statement for updated information on privacy and security policies. Statement last updated June 13, 2022. By using the Site or App, you agree to be bound by the terms of this Privacy Policy. No physical signature is necessary for this Agreement to have legal effect and to be binding upon the Parties.
